Terms of service

1. Scope

These General Terms and Conditions apply to all contracts between Petsamor Co., Limited and consumers concluded through our online shop.

2. Conclusion of contract

The presentation of goods in the online shop does not constitute a legally binding offer. By submitting an order, the consumer makes a binding offer to conclude a purchase contract. The contract is concluded only when shipment is confirmed.

3. Prices and payment terms

All prices include statutory VAT where applicable, plus shipping costs.
The prices stated at the time of ordering apply.

4. Retention of title

The goods remain our property until full payment has been made.

5. Delivery and shipping

Delivery is made to the delivery address provided by the consumer.
Partial deliveries are permitted where reasonable and where no additional costs arise.

6. Statutory warranty

Consumers are entitled to statutory warranty rights under Sections 437 et seq. of the German Civil Code (BGB).
The warranty period is two years from delivery of the goods.
In the event of a defect, the consumer is initially entitled to supplementary performance (repair or replacement delivery).
If supplementary performance fails, the consumer may reduce the purchase price or withdraw from the contract.

7. Guarantee

A manufacturer's guarantee beyond the statutory warranty is granted only if expressly stated in the product description.
Without an express guarantee statement, no additional manufacturer's guarantee exists.

8. Liability

We are liable without limitation for damages arising from injury to life, body or health, and for damages based on intentional or grossly negligent breach of duty.
For slight negligence, we are liable only for breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to foreseeable, typical contractual damage.
Any further liability is excluded.

9. Product use

The consumer is required to use the goods in accordance with the enclosed instructions and safety information.
We accept no liability for damage caused by improper use

10. Electrical and Electronic Equipment Act (WEEE)

We are registered with Stiftung EAR in accordance with the German Electrical and Electronic Equipment Act.

Under the Electrical and Electronic Equipment Act, old electrical and electronic equipment must not be disposed of with household waste. It can be handed in at municipal collection points

11. Battery Act (BattG)

Batteries and accumulators must not be disposed of with household waste. Consumers are legally obliged to return used batteries.
The battery can be returned free of charge at the relevant collection points.

12. Packaging Act (VerpackG)

We are registered with the Central Agency Packaging Register (LUCID) in accordance with the Packaging Act and affiliated with a dual system.

13. Place of jurisdiction

For consumers, the law of the country in which the consumer has their habitual residence applies.
For businesses, the place of jurisdiction is Hong Kong.

14. Severability clause

If individual provisions of these Terms and Conditions are invalid, the validity of the remaining provisions remains unaffected.
